Disputing a Will

Whether you have concerns about the validity of a Will, the way in which an Estate/Trust is being administered or you have not received what you expected to from an Estate, the private client specialist within our Civil Litigation Department will be able to assist. By becoming involved at an early stage and by giving tailored advice, Lamb & Holmes can offer practical solutions to defuse conflict and avoid litigation.

We aim to resolve matters by negotiation, mediation or other methods of alternative dispute resolution. When court proceedings cannot be avoided, we ensure that they are conducted in a professional, skilled and cost-effective manner.

We recognise that many cases by their very nature involve members of the same family. With our sensitive and careful approach, we aim to support the maintaining of family relationships. We will work with you to ensure that your matter is resolved in a timely manner and you are kept fully up to date on the progression of any dispute.

We can help with the following:

  • Breach of Trust claims
  • Contesting the terms or validity of a Will
  • Inheritance claims under the Inheritance (Provision for Family and Dependants) Act 1975
  • Estate disputes
  • Deeds of Variation
  • Claims in relation to property
  • Professional Negligence Claims

The members of the Society of Trust and Estate Practitioners (STEP) specialists within our Probate Department can also assist and advise upon:

  • Court of Protection Applications (link to own page)
  • Lost Wills or Codicils

Due to certain claims being time sensitive under the Limitation Act 1980 we recommend that you contact our teams as soon as possible to discuss any issues which arise. The time limits are strict in respect of probate matters and delays can result in a claim no longer being pursuable. Therefore even if it is just to discuss the possibility of a claim then please contact our specialist so we can give initial advice as to the time limits involved.
